What Is a Financial Agreement?

This agreement deals with the arrangements made to divide money and property following the breakdown of a relationship.

Usually, money and assets including property will have been accumulated during the relationship and this will need to be divided fairly depending on certain factors including the needs of any children involved.

A financial agreement is a legally binding document which is created after a divorcing couple have reached an agreement on a range of important issues. This includes child maintenance, spousal maintenance and the division of property.

Agreeing on a Financial Settlement

Most financial settlements are agreed following a process of negotiation. Whatever form these negotiations take, the legal criteria used by the court are crucial in setting the parameters for any settlement.

First, there must be a full, honest, and clear exchange of financial disclosure to assist the court in finding a ‘fair’ financial settlement for all involved.

No agreement you reach is final unless it has been converted into a consent order and approved by the court. It becomes legally binding once the ‘decree absolute’ has been pronounced.

Although the court needs to approve your financial settlement and grant the divorce or civil partnership dissolution, the court does not need to be involved in the process of exchanging disclosure and negotiating an agreement.

There are many alternatives to court and only a minority of financial settlements are imposed by the court following a contested hearing.
